Terms and conditions

seeker GmbH (hereinafter referred to as “seeker”) provides an electronic communications directory and additional services at its internet addresses seeker.info, seeker.eu, seeker.de, seeker.at and seeker.lu. The services offered at these addresses are, on principle, free of charge to both consumers and businesses.

The following terms and conditions apply to the free use of the services provided. Please peruse the terms and conditions. If you do not approve of one or several of the terms, you may not utilise the services.

The communication and address data you can find through the seeker internet portal are based on the directory data of

  • P&T, Luxembourg
  • BELGACOM, Belgium
  • LSSiDATA, USA
  • A1 Telekom, Austria
  • British Telecom, United Kingdom
  • KPN, the Netherlands and
  • SWISSCOM, Switzerland.

This data is complemented by additional licensed data, data released for publication, and data obtained through own research.

No guarantee is accepted in respect of system availability and in respect of the correctness, topicality and completeness of the entries provided.

Authorised use

Any direct or indirect misuse or abuse is prohibited. This includes, in particular, any use or utilisation of the data and information for business or commercial purposes, whether electronically or in any other form (e.g. telephone directories in text form or on CD ROM), and the preparation for such use or utilisation, e.g. the selection or copying of the data. In so doing, it makes no difference whether entire records or only parts thereof are used or utilised in this way. 

In the context of the authorised use of the data and information, the data protection regulations (e.g. data protection act „Bundesdatenschutzgesetz“) must be observed. 

Users are prohibited from utilising the services in a way that interferes with the proper operation and function of the search engines of seeker and/or other services.



All other rights that are not expressly granted by means of the provisions of this agreement remain with seeker GmbH and/or other holders of rights. Irrespective of the above, users may neither use the internet services or their interfaces nor any other computer program or automated procedure in order to execute an automatic query to search and/or obtain contents (including but not limited to “Scraper”, “Miner”, “Crawler”, “Spider” or “Robots”).

Any abuse of these terms and conditions will result in legal prosecution and entitle seeker GmbH to temporarily or permanently disable access of the corresponding user or IP addresses to all services.

With regard to data and information from BT’s OSIS database in the UK: 

  • Users shall in all their dealings with or relating to the data and information derived from BT’s OSIS database („data and information“), comply with all applicable laws and codes of practice including the Data Protection Act 1998 and the Code of Practice on Telecommunications Directory Information Covering the Fair Processing of Personal Data (21 December 1998);

  • Users shall use all resonable endeavours in relation to the security and confidentiality of the data and information in their custody or control to prevent any unauthorised disclosure of any part of it;

  • If any complaint is made which relates to the User’s use of the data and information then the Users shall assist seeker and BT in investigating the complaint and shall take such steps as are reasonably necessary to remedy the complaint as soon as practicable;

  • Users shall only use or process any of the data and information for their own internal purposes or, in the alternative, for a single use for a single specific person who is the User’s customer;

  • Users shall not distribute, publish or display any material amount of the data or information by any means, except so that a single specific person can use it as permitted by the foregoing bullet point;

  • Users shall not export or permit the export of any material amount of the data and information to a country which is not withing the European Economic Area without the express consent of BT.

  • Users shall not have any rights to use the BT marks and shall not make reference to BT or any BT product or service in any promotional or marketing advertising, communications, literature, or packaging.

  • Users shall not alter any copyright or other intellectual property right acknowledgement or confidentiality marking incorporated into or applied to BT’s OSIS data or documentation owned by BT.

 

 

 

Limitation of liability

seeker GmbH accepts no liability in respect of the availability of its systems or in respect of the correctness, topicality and completeness of the entries.

seeker GmbH accepts no liability – neither in respect of yourself nor any other natural person or legal entity – for any loss of use, income or earnings, for any loss or damage of data, for other commercial or economic, direct or indirect, accidental, special, legal or penalty-related damages or for damages ensuing as a penalty or for consequential damages arising in connection with the use of the software or your reliance on the software.

This limitation of liability does not apply in the event of a grossly negligent or premeditated violation of duty or damage to life, limb and health.

All rights and duties from this contractual relationship are determined in accordance with German law.
